{"id":4897,"date":"2025-04-27T17:55:40","date_gmt":"2025-04-27T16:55:40","guid":{"rendered":"https:\/\/www.mondevudailleurs.ae\/?p=4897"},"modified":"2025-04-27T21:03:53","modified_gmt":"2025-04-27T20:03:53","slug":"sanctioning-ordinary-people-the-risk-of-injustice","status":"publish","type":"post","link":"https:\/\/www.mondevudailleurs.ae\/en\/sanctioning-ordinary-people-the-risk-of-injustice\/","title":{"rendered":"Sanctioning ordinary people: the risk of injustice"},"content":{"rendered":"\n<p style=\"line-height:1.2\">In one of his recent columns for <em>Le Figaro<\/em> entitled &#8220;The misuse of international sanctions&#8221;, Renaud Girard mentions &#8220;a young Russian, who arrived in Switzerland at the age of 15 to study, and who is now a Swiss citizen, perfectly fluent in French, sanctioned simply because his father was the founder of Russian Vallourec&#8230; His bank accounts have been frozen and he is no longer allowed to visit the European Union&#8221;.<br\/>This &#8220;young Russian&#8221; is Alexander Pumpyansky. <\/p>\n\n<p style=\"line-height:1.2\">This &#8220;young Russian&#8221; is Alexander Pumpyansky. <\/p>\n\n<p style=\"line-height:1.2\">The sanctions that have been imposed on him since the start of the war in Ukraine &#8211; on the grounds that he is his father&#8217;s son &#8211; have been continually renewed, despite the fact that the European Union&#8217;s own court has repeatedly annulled these sanctions, admitting that Alexander Pumpyansky is not involved in any way in the conflict that now confronts Russia and Ukraine. Nor, according to the same court, are his father and mother, who have also been sanctioned.  <\/p>\n\n<p style=\"line-height:1.2\">So how did we end up in a situation similar to Kafka&#8217;s <em>The Trial<\/em>, where the Russian-Swiss businessman is under sanction despite being judged innocent? <\/p>\n\n<p style=\"line-height:1.2\">La raison est la suivante : les sanctions, d\u00e9cid\u00e9es par des fonctionnaires non \u00e9lus puis ent\u00e9rin\u00e9es par le Conseil de l\u2019union europ\u00e9enne sans aucun proc\u00e8s ni instruction \u00e0 charge et \u00e0 d\u00e9charge, ont une dur\u00e9e de six mois aux termes desquelles elles sont prolong\u00e9es ou non. Cette r\u00e9\u00e9valuation p\u00e9riodique est cens\u00e9e permettre aux personnes sanctionn\u00e9es de plaider leur cause, devant un juge cette fois. Ce fonctionnement serait \u00e9quitable si, une fois innocent\u00e9, le demandeur \u00e9tait bel et bien retir\u00e9 de la liste des personnes sanctionn\u00e9es. Or ce n\u2019est pas le cas. Bien que le tribunal ait reconnu \u00e0 deux reprises l\u2019injustice faite \u00e0 Alexander Pumpyansky et donc annul\u00e9 les sanctions qui pesaient sur lui, l\u2019homme d\u2019affaire a \u00e0 chaque fois \u00e9t\u00e9 par la suite r\u00e9inscrit sur la liste des personnes sanctionn\u00e9es. Le Conseil se montre donc totalement indiff\u00e9rent \u00e0 l\u2019avis des juges europ\u00e9ens ! En bref, tant que la volont\u00e9 politique de sanctionner un tel ou un tel demeure, les actions intent\u00e9es devant les juridictions europ\u00e9ennes sont d\u00e9pourvues d\u2019effets pratiques. Le tribunal a beau reconna\u00eetre votre innocence, cela ne change rien \u00e0 votre situation. Ce n\u2019est qu\u2019une victoire morale au go\u00fbt amer\u2026        <\/p>\n\n<p style=\"line-height:1.2\">This is a denial of justice. Unfortunately, it is far from being the only case of its kind, as French diplomat Eug\u00e8ne Berg pointed out in <em><a href=\"https:\/\/www.latribune.fr\/opinions\/tribunes\/les-sanctions-internationales-ne-sont-pas-toujours-soigneusement-ciblees-et-c-est-un-vrai-probleme-eugene-berg-1015028.html\">La Tribune<\/a><\/em>. We could console ourselves with the fact that it only affects wealthy Russians. However, this would be to miss the point: while sanctions are necessary to support Ukraine, they need to be fair to be legitimate. We cannot respond to an illegal invasion with arbitrary measures.
